Google and its parent company Alphabet lost their final legal battle against a landmark European Union antitrust penalty on Thursday, after the bloc’s highest court dismissed their appeal and upheld a €4.125 billion ($4.7 billion) fine. The ruling by the European Court of Justice (ECJ) marks the definitive end to an eight-year legal saga over Google’s abuse of its Android operating system to cement its monopoly in online search.

The case dates back to 2018, when the European Commission found that Google had used restrictive licensing conditions and pre-installation agreements to illegally stifle competition. Regulators initially levied a record €4.34 billion fine, detailing how Google forced smartphone manufacturers to pre-install Google Search and the Chrome browser to secure access to the Google Play Store. In 2022, the EU General Court largely validated the Commission’s findings but trimmed the fine to €4.125 billion after adjusting certain anticompetitive metrics.

In Thursday’s final, binding decision, the ECJ rejected Google’s core defenses and ruled that the lower court had not erred in law. The top court affirmed that Google’s aggressive pre-installation mandates capitalized heavily on a “status quo bias” among consumers, effectively ensuring its search engine remained the default gateway for mobile users. While Google previously argued that its practices supported an open-source platform and reflected user preference, the binding verdict cements one of the largest regulatory defeats in tech history and opens the door to potential civil lawsuits from impacted competitors.
