The U.S. Supreme Court ruled 6-3 on Tuesday to strike down President Donald Trump’s executive order seeking to end birthright citizenship, reaffirming that virtually all children born on American soil are automatically citizens under the 14th Amendment.
Chief Justice John Roberts wrote the majority opinion, joined by four other justices, while Justice Brett Kavanaugh wrote separately that the order also violated federal law. Justices Clarence Thomas, Samuel Alito and Neil Gorsuch dissented.
Trump had signed the order on his first day back in the White House in January 2025. An estimated 250,000 babies born in the US annually would have been denied citizenship under the policy, according to the Migration Policy Institute.
Trump reacted on Truth Social, calling the ruling “too bad for our Country” and urging Congress to pass legislation restricting birthright citizenship, insisting no constitutional amendment was necessary.
The decision marks the second major Trump initiative struck down by the court this term, following February’s tariff ruling.
